The Department of Veterans Affairs (VA), Southern AZ VA Health Care System (SAVAHCS) 3601 S. 6th Avenue Tucson, Arizona has awarded a Sole Source Procurement for MiPACS Dental Enterprise System Dental Imaging Software with Lead Technologies, Inc. d/b/a Medicor Imaging, 1201 Greenwood Cliff, Suite 400, Charlotte, NC 282204-2844. The system shall support the Planmeca Digital Radiographic Equipment and images to DRM Plus, VistA Imaging and all current x-ray devices approved by the VA. The system must be compatible with the VA's existing VistA/CPRS systems, Windows XP, Dental Records Manager Plus (DRM Plus) and the VA's antivirus software. The system must have future expansion and upgrading capabilities. The PACS system must be approved by the VA's OCIS-Health Information Security Division on three levels: Technical Vulnerability, Hardening Guideline Comparison, and HIPAA Control Analysis. System has to be capable of DICOM Query and Retrieve for complete inter-connectivity as well as DICOM Storage to VistA.

The following Justification for Other than Full and Open Competition is prepared in accordance with Federal Acquisition Regulation (FAR) Part 6.302-1"Only one responsible source and no other supplies or services will satisfy agency requirements" and the Department of Veterans Affairs Acquisition Regulation (VAAR) 806.304. 1. 2. Description of Action Being Approved

This Justification for Other than Full and Open Competition (JOFOC) comes as a result of a current, on-going requirement at the Southern AZ VA Health Care System (SAVAHCS) to provide the Dental Service a Picture Archiving and Communication System (PACS) approved for use with VistA Imaging for long term image storage as required by VA Executive Decision Memorandum, Subject: Storing PACS Images in VistA Imaging, dated November 2005.

Items being purchased in this acquisition: MIPACS Software Components which consist of MiPACS Storage Server Configurations, MiPACS Dental Enterprise Viewers (24) licenses, MiPACS Patient Updater, Implementation (Installation and Training) at SAVAHCS total number of days on site, Post Installation follow up visit to ensure the MiPACS Digital Imaging Enterprise system performance is at optimal level and to ensure good user experience with the system, number of days for post installation follow up two days and Technical Support which includes telephone and email support during normal business hours 9:00 am to 6:00 pm EST Monday through Friday.

3. Description

Medicore Imaging's MiPACS solution was selected because it has been the only commercial off-the-shelve Dental PACS system able to: automatically acquire any digital image from any acquisition device; view acquired dental images on templates that Dental Service is familiar with (this translates to the MiPACS software has the hanging protocols which VistA does not have and allows dental studies to be saved as acquired in template fashion rather than one-by-one); and save images automatically in an electronic fashion to VistA imaging. VistA imaging does not have the acquisition ability or the dental viewing environment. To the best of our knowledge, the MiPACS solution is the only product available that meets the needs identified by Dental.

4. Statutory Authority/Authority Cited

The basis of this JOFOC is the criteria implemented in the Federal Acquisition Regulation (FAR) Part 6.302-1, "Only one responsible source and no other supplies or services will satisfy agency requirements."

(a) Authority. (1) Citations: 10 U.S.C. 2304(c)(1) or 41 U.S.C. 253(c)(1). (2) When the supplies or services required by the agency are available from only one responsible source, or, for DOD, NASA, and the Coast Guard, from only one or a limited number of responsible sources, and no other type of supplies or services will satisfy agency requirements, full and open competition need not be provided for. 5. Reason for Authority Cited

The reason for citing FAR Part 6.302-1 as the statutory authority for this JOFOC is that it is appropriate in this situation where the agency's needs could only be satisfied by the unique supplies/services available through Medicore Imaging.

Application. This authority shall be used, if appropriate, in preference to the authority in 6.302-7; it shall not be used when any of the other circumstances is applicable. Use of this authority may be appropriate in situations such as the following (these examples are not intended to be all inclusive and do not constitute authority in and of themselves): (1) When there is a reasonable basis to conclude that the agency's minimum needs can only be satisfied by- (i) Unique supplies or services available from only one source or only one supplier with unique capabilities;

6. Demonstrate Proposed Contractor's Unique Qualifications.

The following are some of the items that make Medicore Imaging. a responsible and reliable source:

The system shall support the Planmeca Digital Radiographic Equipment and images to DRM Plus, VistA Imaging and all current x-ray devices approved by the VA.

7. Sources Sought Efforts.

The MiPACs product is the only product currently on the market that has the hanging protocols to view dental images that is compatible with VistA Imaging.

8. Determination of Fair/Reasonable Price.

The price offered by Medicore is considered reasonable.

9. Description of the Market Research Conducted and Results.

Software is approved by Silver Springs for use with VistA Imaging. This requirement will be posted on FEDBIZOPS for ten days to give contractors the opportunity to submit quotes. If no other firms are technically acceptable award will be made to Medicore Imaging
